TERMS AND CONDITIONS
RISK IN UNDERTAKING A SESSION
Mountain Biking can be an inherently dangerous activity by design. Dirt Maidens will provide you or your child with instruction in an appropriately safe working environment and provide you with a fully qualified, experienced and insured instructor. Participants will not be placed under any pressure to perform skills if they do not feel comfortable in doing so.
ACKNOWLEDGEMENT – You acknowledge that cycling involves a risk of injury and/or death and damage to property. It is your decision alone as to whether you or your child participate in any Session and if you have any doubts as to your abilities or competence you should not participate in the Session.
Further to the above, you understand that there is an inherent risk in undertaking a Session. For example (but not limited to):
you may be injured, physically or mentally, or may die;
your personal property may be lost or damaged;
other persons participating in a Session may cause you injury or may damage your property;
you may cause injury to other persons or damage their property;
the conditions in which the activity is conducted may vary without warning; and
on that basis you agree to assume the risk of, and responsibility for, any injury, death or property damage resulting from your participation in the activity.
AMBULANCE & MEDICAL TREATMENT
In the event of an emergency, you authorise us to request an ambulance on your behalf (and you agree to bear the expense of that ambulance) and you agree to receive (and bear the expense of) any first aid provided by a qualified or registered medical personnel.
INSURANCE
All our participants are strongly advised to take out their own insurance. Auscycle offers an affordable lifestyle insurance option and participants are encouraged to purchase this. Dirt Maidens will not accept any liability for injuries or illness caused whilst attending our activities providing that we are not directly at fault.
PHYSICAL CONDITION
Participants are required to notify us of any personal disability or medical condition, physical or mental, which may affect their ability to take part in the Session. Providing details allows us to do our best to provide you with a great experience.
You promise and represent on the date of the booking, and repeat such warranty and representation each time you participate in a Session, that you are in good physical condition and that you know of no medical or other reason why you are not capable of engaging in a Session or in active or passive exercise and that such exercise would not be detrimental to your health, safety, comfort or physical condition. Dirt Maidens are not qualified to assess whether you are in good physical condition and/or that you can engage in active or passive exercise without detriment to your health, safety, comfort or physical condition.
You must not participate in sessions whilst suffering from any infections or contagious illness, disease or other ailment or whilst suffering from any physical ailment such as open cuts or sores or minor infections where there is a risk, however small, to other riders.
EQUIPMENT
Participants are to ensure that they arrive with an appropriate, well maintained mountain bike fit for technical off road trails. (Hybrids and Town Bikes are not suitable.)
All clients must wear the minimum Personal Protective Equipment:
-Australian Standard Bike Helmet Standard (meets AS/NZS 2063).
-Eye protection such as sunglasses or clear glasses
-Full fingered gloves
-Knee Pads and Elbow Pads are optional
Participants should have the capacity to carry at least 500ml of water. Clothing appropriate to the weather conditions should be worn.
CHILDREN
Our minimum requirement for children is 7 years of age. When teaching minors, Dirt Maidens’ insurance states there must be a minimum of three participants in a session. If this minimum ratio is not met, the session is not able to go ahead as our insurance will become void. It is important to let us know by phone if you are unable to make a session, as we may need to contact other families. If a Session is canceled, a makeup session will be offered. As parent/guardian, you would also need to ensure the child has a proper, well maintained mountain bike suitable for trail riding. Please ask us if you are unsure about anything related to the child’s participation.
Term programs are based on a ten week term. Nine sessions are scheduled and the tenth week will be used as a makeup week if any sessions are canceled. If no sessions are canceled, then we will offer the week 10 Session as a bonus Session.
PAYMENT
All fees are subject to full payment before services are rendered.
Dirt Maidens have the right to cancel Sessions at any time when the well being and safety of participants is compromised due to riding conditions being unacceptable or for any other circumstances which are outside the control of Dirt Maidens. An alternative date to complete the session, or credit to an agreed value will be given in all circumstances. A full refund will also be considered under some circumstances under the discretion of Dirt Maidens.
REFUNDS and CANCELLATION – There is no refund of any prepaid coaching unless the Session is canceled or if you can show, with supporting medical evidence that the program will cause you physical harm or result in physical injury to you or as otherwise required by law in which case the fee will be refunded to you for the prepaid component. The fee will be refunded after the end of the month in which we are provided in writing by you of such medical evidence from a registered medical practitioner. The fee will be refunded minus a $25 administration fee.
TRANSFERS- All requests to transfer will incur a $25 administration fee.
Any request to transfer prior to 7 days before the Session will be accommodated.
Any request to transfer within 48hrs-7 days of the Session will be accommodated if your spot can be filled. If not, you will be granted 50% credit towards a future clinic, OR you can opt to be placed on a ‘stand-by’ list. If you are on Stand-by and at 48hrs prior to the commencement of a Session there is a spot available, you will be offered a place.
Any request to transfer within 48hrs of the Session will be accommodated if your spot can be filled. If not, you will be given the option of going on a ‘stand-by’ list. WET WEATHER POLICY
Dirt Maidens is committed to your safety. If very wet or unsafe conditions are predicted your Session will be cancelled via text message or phone call to your provided mobile 1 hour prior to commencing our Session. All cancelled Sessions due to wet weather will be rescheduled in the case of a Term Program session or rescheduled or refunded in the case of any other session.
MEDIA AND IMAGES
By participating in a Session you consent to us using photos and videos of you or your child in any promotion or other material in relation to the business without reference to you and without compensation or remuneration to you.
